Digital Millennium Copyright Act Notice

Modfynity respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Platform that are reported to our Designated Copyright Agent.

1. Submitting a DMCA Takedown Notice

If you are a copyright owner, or authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, and you believe in good faith that your work has been infringed, please submit a notice of infringement that includes the following information:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or, if multiple works are involved, a representative list of such works.
  2. Identification of the infringing material: A description of the material you claim is infringing (including the URL or other location on the Platform where the material is found) sufficient to permit us to locate the material.
  3. Contact Information: Your name, mailing address, telephone number, and email address.
  4. Statement of Good Faith: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy: A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  6. Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

2. Counter-Notice Procedures

If you believe that your content was removed by mistake or misidentification, you may submit a counter-notice containing the following information:

  • Identification of the material: The material that has been removed and the location where it appeared before it was removed.
  • Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • Contact Information: Your name, address, telephone number, and email address.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Signature: Your physical or electronic signature.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Modfynity has adopted a policy of terminating, in appropriate circumstances and at Modfynity's sole discretion, users who are deemed to be repeat infringers. Modfynity may also at its sole discretion limit access to the Platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

4. Misrepresentations

Please be aware that under 17 U.S.C. § 512(f), you may be liable for any damages, including costs and attorneys' fees incurred by us or our users, if you knowingly materially misrepresent that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification.
