By accessing or using Modfynity ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to update these terms at any time without prior notice. Your continued use of the Platform following any changes indicates your acceptance of the new Terms of Service.

2. User Accounts

To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

3. User-Generated Content

Modfynity allows users to upload, post, and share content, including but not limited to game modifications ("Mods"), images, and comments. You retain ownership of your content, but you grant Modfynity a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your content in connection with the Platform's services.

• You must own the rights to the content you upload or have explicit permission from the rights holder.
• You agree not to upload content that contains malicious software, viruses, or any harmful code.
• You agree not to upload content that infringes on the intellectual property rights of others.
• You acknowledge that Modfynity acts as a passive conduit for your online distribution and publication of User Content and has no obligation to screen or monitor User Content.

4. Intellectual Property Rights

Modfynity respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA). If you believe your work has been copied in a way that constitutes copyright infringement, please refer to our DMCA Policy.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Use the Platform for any illegal purpose or in violation of any local, state, national, or international law.
• Harass, threaten, or intimidate other users or Modfynity staff.
• Attempt to restrict or inhibit any other user from using and enjoying the Platform.
• Reverse engineer, decompile, or disassemble any aspect of the Platform.
• Use automated systems (bots, spiders, scrapers) to access the Platform without prior written permission.

6. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied. Modfynity does not guarantee that the Platform will be secure, error-free, uninterrupted, or free of viruses or other harmful components. You use the Platform at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Modfynity, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this service.

Under no circumstances will Modfynity be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the service or your account or the information contained therein.

8. Indemnification

You agree to defend, indemnify, and hold harmless Modfynity and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the site operator is based, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Termination

We reserve the right to terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service.
